1. Introduction and Acceptance

Welcome to PetsEgypt.com. The website, together with the PetsEgypt mobile applications, is owned, managed and operated by Pet Shop Egypt (referred to in these terms as PetsEgypt, we, us or our). These Terms and Conditions govern your access to and use of our website, applications, and the products and services we offer.

By browsing, registering an account, or placing an order through any of our platforms, you confirm that you have read, understood and agree to be bound by these Terms and Conditions, together with our Privacy Policy, Returns and Refunds Policy, and any other notices, disclaimers or terms that appear on our platforms. If you do not agree with any part of these terms, please do not use our website or applications.

You confirm that you are at least 18 years of age, or that you are using our platforms under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding agreement. You agree to provide accurate and complete information when you register or place an order and to keep that information up to date.

2. Changes to These Terms

We may update, revise or replace any part of these Terms and Conditions at any time and at our sole discretion. Changes take effect once they are posted on our platforms. It is your responsibility to review these terms periodically. Your continued use of our website, applications or services after any change means that you accept the revised terms. The version in force at the time you place an order is the version that applies to that order.

3. Products, Pricing and Errors

We work hard to keep product descriptions, images, pricing and availability accurate, but we do not warrant that this information is always complete, current or free of error. Product listings may occasionally contain inaccuracies relating to price, description, availability or other details.

We reserve the right, at any time and without prior notice, to correct any errors, change or update information, cancel affected orders, and refund any amount already paid for a cancelled order. Prices and product terms may change without notice. Products offered through our platforms are intended for personal use only and not for resale.

4. Orders and Acceptance

When you place an order you are making an offer to purchase the selected products subject to these terms. Your order is not accepted until we confirm it and dispatch the products. We reserve the right to accept or decline any order, in whole or in part, for any reason, including suspected fraud, pricing or description errors, product unavailability, or a breach of these terms. If we cancel an order after payment has been made, we will refund the amount paid for the cancelled items.

5. Shipping and Delivery

We deliver on business days. Delivery times are estimates only and are not guaranteed. You are responsible for providing accurate and complete delivery information, including the correct address and contact details. We are not responsible for delays, failed deliveries, or additional charges that result from incorrect or incomplete information provided by you.

Where a delivery is refused for any reason other than the delivery of a wrong item, additional charges may apply. Packages may be opened and inspected for security and quality assurance purposes. Risk of loss and damage to the products passes to you at the time of delivery to the address you provided or to any person present at that address who accepts the delivery on your behalf.

Shipping charges are calculated at checkout based on the average weight and dimensions of the package and the delivery destination.

6. Returns, Exchanges and Cancellations

Once an online order has been placed and paid for, it cannot be refunded until the product has been returned to us in accordance with this section and our Returns and Refunds Policy. Products may be returned or exchanged within 5 business days of delivery, provided they are unused, undamaged and in their original packaging.

Returns are subject to a restocking fee of 15 percent of the product value and exclude the original shipping charges, which are non refundable. Certain products may be non returnable for hygiene, safety or perishability reasons. 7. Warranty and Product Disclaimer

Except where a manufacturer or third party provides a specific written warranty, all products are sold on an as is basis without any warranty of any kind from PetsEgypt, whether express or implied. Where a third party warranty applies, it is provided and honoured solely by that manufacturer or third party and is subject to their terms and conditions.

Any third party warranty is void if the product has been tampered with, misused, altered, or used other than in accordance with its instructions. Repairs, replacements or claims under a third party warranty depend entirely on that third party's policy. Products submitted for a warranty claim must be returned with their original packaging and proof of purchase.

8. Pet Safety and Proper Use

The products we sell are intended for use with animals, and the health, safety and wellbeing of your pet is your responsibility. Information provided on our platforms, including product descriptions, care tips and articles, is for general information only and does not constitute veterinary advice. It is not a substitute for professional consultation with a qualified veterinarian.

You are responsible for confirming that any product is suitable and safe for your particular animal before use, for following all label directions, dosage guidance, age and species recommendations, and safety warnings, and for supervising your pet during use where appropriate. Animals can react unpredictably, and individual pets may experience allergic reactions, sensitivities or adverse effects to food, treats, medication, grooming products, toys or accessories.

To the fullest extent permitted by law, PetsEgypt is not liable for any illness, injury, allergic reaction, harm or death to any animal or person, or for any other loss or damage, arising from the choice, use, misuse, or handling of any product purchased through our platforms. If you have any doubt about a product's suitability for your pet, consult a veterinarian before use.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PetsEgypt, together with its owners, directors, employees, agents, suppliers and partners, shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, veterinary or medical costs, or any other intangible losses, arising out of or in connection with your use of our platforms, your purchase or use of any product, or any delay or inability to use our platforms, whether based on contract, tort, negligence, strict liability or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability to you for any and all claims arising out of or relating to a product or an order, or to your use of our platforms, shall not exceed the total amount you actually paid for the specific product or order that gave rise to the claim. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the applicable law of the Arab Republic of Egypt.

10. Indemnification

You agree to indemnify, defend and hold harmless PetsEgypt and its owners, directors, employees, agents, suppliers and partners from and against any claims, demands, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms and Conditions, your misuse of our platforms or any product, your violation of any law or the rights of any third party, or any content you submit through our platforms.

11. Disclaimer of Warranties

Our website and applications are provided on an as is and as available basis without warranties of any kind, whether express or implied. We do not warrant that our platforms will be uninterrupted, timely, secure or free of errors, viruses or other harmful components, that defects will be corrected, or that the content and information provided is accurate, reliable or complete. Your use of our platforms is at your own risk, and you are responsible for maintaining suitable security on your own devices.

12. User Content and Reviews

Our platforms may allow you to submit reviews, ratings, comments or other content. You are solely responsible for any content you submit and confirm that it is accurate, lawful, does not infringe the rights of any third party, and is not offensive, misleading or defamatory. PetsEgypt shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond our reasonable control. These events include, without limitation, natural disasters, extreme weather, fire, flood, epidemics or pandemics, war, civil unrest, acts of terrorism, government actions or restrictions, strikes or labour disputes, failures of utilities, internet or telecommunications, and disruptions to shipping, courier or supply chain services.

15. Intellectual Property and Proprietary Rights

All content on our platforms, including text, graphics, logos, images, product descriptions, page layouts, and software, is the property of PetsEgypt or its content suppliers and is protected by intellectual property laws. Trademarks, brand names and logos displayed on our platforms belong to their respective owners. You may not copy, reproduce, republish, distribute, or exploit any part of our platforms for commercial purposes without our prior written permission.

16. Privacy and Data Protection

We collect and process personal information in order to fulfil orders, operate our platforms, and improve our service. The information we handle may include account details, order and purchase history, cookies, and technical data about how you use our platforms. We do not sell your personal data. We may share it with trusted partners who help us fulfil and deliver your orders and operate our business, and only to the extent necessary for those purposes.
